Man sentenced for life over exposing minor to HIV after defiling her

A Narok court on Tuesday sentenced a man to life imprisonment after it found him guilty of defilement and exposing a minor to HIV/AIDS.

While delivering the judgement, Narok Senior Resident Magistrate Hoseah Ng’ang’a stated that the hospital report showed that the victim had been attacked and sexually assaulted but was safe of infection after undergoing emergency treatment.

The Magistrate pointed out that the accused, who stood guilty as charged, took advantage of the vulnerability of the minor thereby causing her permanent trauma.

The accused, Samson Tobiko, is alleged to have committed the act on August 27, 2018 at Ildamat village in Narok County.

The court heard that the victim allegedly followed, touched and thereafter defiled the eight-year-old girl, who is also his step-daughter, in a maize plantation after she had served him with porridge at their house.

The victim also allegedly threatened the minor not to reveal the ordeal failure to which he would deal with her severely.

The victim’s mother later learnt of the act and in the company of another woman reported the matter at Sabutiek Police Station in Ntulele, leading to the suspect’s arrest.

The accused has two weeks to appeal.
