Court dismisses application challenging order to stop Sonko’s impeachment

The Labor court has extended stay orders that suspended the indictment of Nairobi Governor Mike Sonko.

The court likewise struck out ex-Nairobi County Assembly Speaker Beatrice Elachi’s application challenging an order to stop Sonko’s impeachment in early March.

“In conclusion the primary objection dated and filed on 4.03.2020 for the 2nd respondent is hereby dismissed,” read the court orders.

The second respondent was former Nairobi County Assembly Speaker Beatrice Elachi.

Justice Byram Ongaya extended interim orders that had been given on March 2, 2020 to a further date when the case will be mentioned.

Ongaya also requested Elachi to pay the solicitor’s expenses of the preliminary objection.

Elachi had disagreed with the court, saying they had shed the matter of who is the clerk with the board selecting Monica Muthami as acting assistant, replacing Jacob Ngwele.

She had said that an impromptu advisory committee formed by the the assembly last year in November to investigate the issues encompassing the appointment of Ngwele as the clerk set up that he was inappropriately selected.

“The report was made public and no person, including Ngwele himself, has ever challenged the report,” Elachi stated at the time.
