High Court Judge John Chigiti has issued a summon to the Police Inspector General, Japheth Koome, requesting an explanation as to why Ministry of Defence Principal Secretary, Patrick Mariru, has not been apprehended for his failure to disburse Ksh. 52 million to nine former army officials. This action follows information brought before the court, indicating that the Inspector General has not executed a warrant against the Principal Secretary.
According to court documents, it has been emphasized that the Principal Secretary, in his capacity as the accounting officer within the Ministry of Defence, bears responsibility for this matter.
Justice Chigiti has specifically ordered the Inspector General to personally appear in court on October 25th.
Back in 2013, the High Court had issued a judgment awarding Ksh. 55 million to nine former members of the Kenya Air Force who had suffered torture during the failed coup attempt of 1982. At that time, Justice Isaac Lenaola, serving as a High Court judge, had decreed that each of the petitioners should receive Ksh. 5.5 million for the eight months of suffering they endured between August 1982 and March 1983.
